MCA perceived Corona Surge difficulties of Stakeholders and relaxed the rules, Filings of Forms to be done Between 01/04/2021 to 31/05/2021 can now be filed by 31/07/2021 without additional fees
FILINGS OF FORMS APPLICABLE BETWEEN 01/04/2021 TO 31/05/2021 CAN BE FILED WITHOUT ADDITIONAL FEES BY 31/07/2021 AS PRONOUNCED BY MINISTRY OF CORPORATE AFFAIRS
MCA has expressed its generosity once again on its stakeholders. Extended the filing deadlines for its stakeholders observing the difficulties faced by them due to the Second wave Pandemic Surge. Circulars 6/2021, 7/2021 and 8/2021 issued by the Ministry for pronouncement of relaxations.
Circular No.6/2021 specifically states about the additional fee levy relaxation under Companies Act,2013 and LLP act, 2008.
Circular No.7/2021 specifically states about the time lines of Charge Creations and Modification forms relaxation under Companies Act'2013.
Circular No.8/2021 specifically states about the extension of 60 days more gap of time between two board meetings. (i.e. 120+60 = 180 days gap is accepted for one time)
All Circulars have been issued in the interest of Stakeholders by Ministry of Corporate Affairs.
Requests have been received from country wide stakeholders to relax the norms as the whole country is facing Covid-19 restrictions and disruptions at large. MCA acted in favour of the stakeholders considering the resurgence of Covid-19 pandemic. Accordingly Companies and LLPs have been allowed additional time to file the forms which were due to be filed in the month of April and May 2021. Additional fees applicable to the MCA forms will also be waived off till 31 july'2021. Normal fees have to be paid till the extended date.
Additional fees waive off is applicable only to the forms which are to be filed between 01/04/2021 to 31/05/2021. No other forms fees can be included in the waive off list.
Government using its powers under various sections of Companies Act'2013 giving relaxations to Condone the delay in filing the charge forms.
Ministry has also given clarification on gap to be maintained between two board meetings to be held. 60 days in addition to the existing timelines is given as relaxation.
There should not be a gap beyond 120 days between two board meetings. Due to the difficulties arsied by covid-19 resurgence conducting board meetings time gap is extended by another 60 days. As per this relaxation, For the Year 2021-22 gap between two consecutive board meetings to be held cannot be beyond 180 days(120+60) and this is applicable only for the first and second quarters of the year.
MCA is making changes to the system to arrange the relaxations in order. Stakeholders are now at the cloud nine feeling due to the relaxations.
